Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:

proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
At the Tile Center warehouse; the employees were driving a power
industrial truck
trademark Daewoo, model G25E-2, serial number CX-04055, type LP to move,
dispatch
and store tiles packages and pallets located on metal shelves up to four
levels, with height
of one level to another was 4 feet. The shelves were not anchored to the
floor, as often
could provoked that the forklift hit the shelves and this were moving and
could provoked
the shelves fallen and/or the merchandise of its. The shelves were
designated for
anchorage to the floor, since your stand was spaces to put the screws.
Hazard: Fallinf of the shelves and/or the merchandise above the employees.
Among other correction methods, a feasible and acceptable was anchor the
shelves
to the
floor.
En el almacen de "Tile Center"; los empleados manejaban un montacarga marca
"Daewoo", modelo G25E-2, numero de serie CX-04055, tipo LP mara mover,
despachar
y almacenar paquetes y cajas de losas colocadas en anaqueles de metal de
hasta cuatro
niveles, cuya altura entre un nivel a otro era de 4 pies. Los anaqueles no
estaban
anclados al piso, lo cual podia ocasionar que el montacarga golpeara los
anaqueles y
estos se movieran y pudieran causar la caida de los mismos y/o la
mercancia que
contenian. Los anaqueles estaban disenados para estar anclados al piso, ya
que en su
soporte tenian los espacios para colocarle los tornillos.
Riesgo: Caida de los anaqueles y/o la mercancia encima de los empleados.
Entre otros metodos de correccion uno factible y aceptable seria anclar
los anaqueles al
piso.eles
