Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to hits:

El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban
expuestos
a golpes:
At the Aqua Blue project, where Morris Shea Bridge Company Inc., was a sub-
contractor of pile driving, an employee of this Company was hit by a piece
of land that
fell from the auger, while he was installing the auger plug. The employer
did not assure
that the necesary safety measures were taken to prevent that the employees
were hit by
pieces of land accumulated on the auger, not complying with their own
procedures, the
which established that before an employee put the auger plug, they have to
located the
forklift with the a steel plate or the loader to protect the employee.
Process that was not
realized, causing that the employee was hit suffering injuries in his back
that required
hospitalization.
Hazard: Hit by pieces of land.
Among other methods, a feasible and acceptable to correct these hazard is
located
the
forklift with the a steel plate, a loader or put an auger cleaner.
En el Proyecto de Aqua Blue, donde Morris Shea Bridge Company Inc., se
encontraba
como sub-contratista de hincado de pilotes, un empleado de dicha compania
fue golpeado
por un pedazo de tierra, que cayo desde la barrena, mientras instalaba el
tapon de la
misma. El patrono no se aseguro que se tomaran las medidas de seguridad
necesarias
para evitar que los empleados fueran golpeados por pedazos de tierra
acumulados en la
barrena, incumpliendo con su propio procedimiento, el cual indicaba que
antes de que
el empleado colocara el tapon debajo de la barrena tenian que localizar el
"forklift" con
una plancha de acero o el "loader", para proteger al empleado.
Procedimiento que no se
llevo a cabo, ocasionando que el empleado fuera golpeado sufriendo
lesiones en la
espalda, que requirieron hospitalizacion.
Riesgo: Golpeado por pedazos de tierra.
Entre otros metodos, uno factible y aceptable para corregir este riesgo es
colocar el
"forklift" con la plancha de acero, el "loader" o colocarle la limpiadora
de barrena.ra
