Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:08/26/04 Location:North Side of Central Distribution Warehouse, Bay Door 36 Equipment:C6500 GMC Cargo Truck, #637, VIN 1GDJ7H1C1YJ509135 Condition:A cargo truck having an inoperable handbrake and no wheel chocks was being loaded with palletized merchandise by an employee using an electric powered industrial truck. Among other methods, one feasible and acceptable abatement method to correct this hazard is to establish an inspection program to ensure that each delivery truck is in safe operating condition, with operable brakes as required by Federal Motor Vehicle Carrier Safety Administration Regulations and Federal Motor Vehicle Safety Standard, and implement a verification procedure to ensure the inspections are actually performed prior to driving, and that all defects noted are correct. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
