Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of working over and near water:
and/or in the alternative:
29 CFR 1926.21(b)(2):  The employer did not instruct each employee in the
recognition and
avoidance of unsafe conditions and the regulations applicable to his work
environment to control
or eliminate any hazards or the other exposure to illness or injury:
29 CFR 1926.106(c):  Ring buoys with at least 90 feet of line were not
provided and readily
available for emergency rescue operations:
29 CFR 1926.106(d):  A lifesaving skiff was not immediately available at
locations where
employees were working over or adjacent to water:
(a)  On or about 05/05/05 a laborer was drowned while working with a crew
to clear logs
and trash form under a bridge over the Little River.  The river washes
deep holes with nearly
vertical, slippery sides in the area where they were working was known for
drowning.  A 1/4
inch (.6cm) plastic rope was thrown to victim, but the wind carried it
away.  A weak swimmer
jumped into the river, but was unable to rescue victim.  The body was
later put into a boat and
taken away in a black bag. One method among others to abate this hazard is
to:
Provide instruction in:  Water safety and rescue (i.e. "Reach as in using
a tree branch or
other object to try to reach the swimmer from shore, throw something
buoyant such as ring
buoys with at least 90 feet of line to the swimmer, then row as in using a
lifesaving skiff to row
