Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Employees sorting clothes, furniture, appliances, etc., in a metal building withuot air conditioning are experiencing heat exhaustion symptoms where the temperature on July 12, 2005, was 96 degrees and the humidity was 94 Trucks are loaded and driven that do not have air conditioning further exposing the employees to heat stress. Feasible methods of abatement would be to limit the employees exposure to the heat and humidity by not allowing them to work in the hot afternoons. Air condition the work area. Air condition the delivery truck cabs.
