Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an amputation hazard. a) On or about October 25, 2005, where the point of operation guarding was not feasible for two press brakes (Verson and Niagara) the employer did not develop and implement a minimum safe distance program for the protection of press brake operators. One feasible and acceptable means of abatement method is to develop and implement a safe distance program that conforms to the requirements of ANSI B11.3-1982, and OSHA Directive CPL 02-01.025.
