North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to struck-by, fall from greater elevation: a)facility, "skylight" warehouse, employees were exposed to the hazard of falling through/being struck by objects falling through the floor into the basement due to numerous sags and holes in the concrete covered wooden floor of the warehouse. NOTE: Among other methods, one feasible and acceptable method to abate is to correct existing unsafe conditions, i.e., leaking roof, deteriorating floor, sprinkler systems, and hire a professional structural engineer to determine the rated weight capabilities and to correct the existing floor accordingly.
