A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees, in that the employer did not ensure that restraining devices (i.e., seat belts) were installed on each forklift to restrain the operator in the event of a rollover as recommended in the American National Standards Institute: a) 2119 W. Portland St., Phoenix, AZ 85009: An orange Toyota forklift, model #40- 4FGC20, serial #404FGC25-15788, was not equipped with a seat belt to restrain the operator in the event of a rollover in accordance with the American National Standards Institute (ANSI) B56.1.
