Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falling/struck-by hazards:
a) Employees were exposed to the hazard of falling off of a deformed rider
step on truck #1.
b) The container locking devices ( trunnion pivot plates) were inoperable
on truck # 5, a rear
load truck, creating a hazard of an employee being struck by a container
as it is lifted for
tipping.
Feasible and acceptable methods of abatement include but are not limited
to: 1) Repairing the
rear rider step on truck #1 to provide a level surface for employees to
stand on. 2) Repairing
the pivot plate on truck #5 to provide a safe method of raising
containers. 3) Implement a pre-
trip inspection procedure of trucks  as detailed in the Manual of
Recommended Safety Practices,
Part IV : Mobile Collection & Transportation Operations, issued by the
Environmental Industry
