Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards: a) Ciccone Construction Company permitted employees to access, and did not barricade, areas within the swing radius of the rear of the rotating superstructure of a Hitachi 200 LC excavator. Employees were exposed to a struck-by hazard and the hazard of being crushed between the excavator tracks and the rotating superstructure. Among other feasible and acceptable methods to correct this hazard include barricading the area to prevent employee entry. No abatement certification or documentation required for this item.
