Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to being struck by falling objects
due to a hoist that was not inspected:
(a) Hanson Asphalt Plant, Ligonier PA:  On or about 3/2/05, the employer
did not develop a
preventative maintenance program for the chain fall hoist used at the
facility.  The hoist has not been
inspected on a regular basis.  The hook had been welded and modified to
accept a bolt.  In addition
the capacity of the hoist was not marked.
One acceptable means of abatement is to develop a preventative maintenance
program according to the
manufacturer's specifications.  In addition, conduct regular inspections
of the hoist and ensure that the
capacity of the hoist is marked.
