Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling loads and/or falling hoist parts: (a) Tar Room; On or about March 29, 2005, the following deficiencies were noted for the P&H 4 ton hoist in the Tar Room: (1) There are no periodic, documented inspections of the hoist. (2) The rated load was not permanently marked on the hoist. (3) The pendant control buttons were not marked. Among other methods, one feasible and acceptable abatement method to correct these hazards is to develop a preventative maintenance program which incorporates all recommendations outlined in the manufacturer's manuals with written, signed and dated reports. These reports should also be in accordance with ANSI B30.16 in order to ensure a safe and properly functioning hoist.oning
