Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling out of powered industrial trucks that were not equipped with seat belts: (a) Production Area: On or about 1/5/06, forklifts that were used on uneven terrain were not equipped with seat belts. The employer did not contact the manufacturer to determine if there was a retro fit kit available for the forklift. Among other methods, one feasible and acceptable means of abatement is to contact the manufacturer and install the applicable retro fit kits for the seat belts to the powered industrial trucks.ial

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard caused by failure of jack stands: (a) North and South Shops: On or about 1/5/06, the jack stands that are used to support rail cars under repair are not rated, certified, nor clearly marked to indicate the capacity that they can safely support. In addition, the jack stands are not on a regular inspection cycle. Among other methods, one feasible and acceptable means of abatement to correct this hazard is to follow the guidelines as outlined in ASME PALD-2003, Parts 4 through 15.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling loads related to the lack of care and maintenance of the lever hoists: (a) Production Area: On or about 1/5/06, the employer did not implement a preventive maintenance program for the use of the CM Series 653 lever hoists. In addition, the latch was broken on a CM Series 653 lever hoist in the South Shop. Among other methods, a feasible and acceptable means of for this item would be the development of a preventive maintenance program consistent with the manufacturer's specifications for the lever hoist and with ASME B30.21-1999 Section 21-1.2.2(c)(3).

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to exposed to crushing and amputations from unintended activation: (a) Fab Shop: On or about 1/5/06, employees were exposed to unintended activation of the mechanical press brake because of an unguarded foot pedal. (b) Fab Shop: On or about 1/5/06, employees were exposed to unintended activation of the mechanical shear because of an unguarded foot pedal. Among other methods, one feasible and acceptable means of abatement to correct this hazard is to guard the foot pedal in accordance with ANSI B11.3; Section 4.2.4.2.4 for the press brake and ANSI B11.4; Section 4.3.2.4 for the shear.
