Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which is free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to serious injuries from falling when they are lifted approximately 7 to 15 feet on platforms that have no guardrails and are not securely attached to the forks of a powered industrial forklift truck. (a) Shipping/Receiving Area, Sears Store #1594, Beaver Valley Mall, Monaca, PA: The employer does not ensure that each employee moving merchandise onto the second level of a shelving unit is protected from falling when lifted on the forks of a forklift truck on top of a flat dolly that is not securely attached to the forks of the truck and has no guardrails. An example of this violation occurred on or about April 13, 2005, when an employee fell approximately eight feet to the ground and an unsecured flat dolly fell on top of him. To abate this specific instance and ensure compliance at all future worksites, the employer must ensure that each employee does not utilize the flat dolly attached to the forks of the forktruck. (b) Shipping/Receiving Area, Sears Store #1594, Beaver Valley Mall, Monaca, PA: The employer does not ensure that each employee is protected from falling when moving merchandise onto the second level of a shelving unit when lifted on the forks of a forklift truck on top of a wooden pallet which is not secured to the forks, nor has standard guardrails. An example of this violation occurred on or about April 19, 2005 when an employee stood on an unguarded wooden pallet attached to the forks of the forklift. To abate this specific instance and ensure compliance at all future work sites, the employer must ensure that a lifting platform, designed and approved for such use is secured to the forks of an industrial truck as per the American National Standard Institute Safety Standard for Lowlift and Highlift trucks, ANSI/ASME B56.1 - 2000, Sections 7.36.1 and 7.36.3. All platforms must be in accordance with the manufacturer's specifications. Pursuant to 29 CFR 1903.19(d)(, the employer must provide documentation that this specific instance has been abated within ten calendar days of the date it receives the citation.
