Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to : (a) Jobsite: On or about June 9, 2005, employee were working around concrete form pins that were not fitted with caps nor were they level with the concrete forms. This condition posed an impalement hazard to employees. Among other methods two feasible and acceptable method to correct this hazard is to install the form pins flush with the concrete forms and/or place caps on the concrete forms.te
