Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards. 1.On or about September 11, 2004, at the Tri-County Construction Inc., worksite trailer ramps were modified without the approval of the manufacturer, exposing employees to struck-by hazards. Among other methods, one feasible and acceptable method to correct this hazard would be using the equipment in accordance with the manufacturer and seek approval of manufacturer prior to modifying equipment.
