Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards while riding the excavator bucket in and out of the trench: (a)Located at Hwy 31 North, Calera, Alabama - On or about 09/01/2004, the worker rode the bucket of the excavator in and out of the 14 feet to 15 feet deep trench. Among other methods, one feasible and acceptable method to correct this hazard is to use a ladder to enter and exit the trench excavation.
