Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential falls while working on a load of plywood elevated on the forks of an all terrain forklift. a) On or about 10/5/04, on the south side of the new building, above the main entrance, an employee was observed on a stack of plywood elevated 9 feet by a SKYTRAK all terrain forklift. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS CONDITION IS: 1) Prohibit employees from using an elevated load as a work platform. 2) Extend the load to a postion above the roof so the employee does not need to use the elevated plywood as a work platform. NO ABATEMENT CERTIFICATION REQUIRED
