Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of toxic chemical inhalation and chemical burns from 93sulfuric acid resulting from an uncontrolled release of concentrated sulfuric acid due to inadequate maintenance and inspection of the storage tanks: a.At Sloss Industries, Coke By-Products area: On or about October 26, 2004, employees were exposed to potential chemical burns and inhalation hazards when a catastrophic failure of the T-78 storage tank and breach of the dike released approximately 60,000 gallons of concentrated sulfuric acid. Among other methods, one feasible and acceptable method to correct this hazard is: Implement a program for maintenance and inspection as outlined in publication API Standard 653, American Petroleum Institute, Tank Inspection, Repair, Alteration and Reconstruction.
