Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falls from the elevated wooden pallet:
(a)Located at the Sonic restaurant site - Valley Ave, Birmingham, Alabama -
GRADALL 5340 All-terrain forklift - On or about 12/21/2004, the worker
using
the cutting torch while standing on the wooden pallet that was elevated by
the
forklift was exposed to fall hazards.
Among other methods, one feasible and acceptable method to correct this
hazard is to use a
manufacturer's approved personnel platform in accordance with ASME
B56.6-1992, Safety
Standard for Rough Terrain Forklift Trucks.t
