General-duty citation text
Section 5 (a) (1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to severe burn injuries and smoke inhalation due to the potential for prolonged and exacerbated fires where flame detection systems were not maintained for automated powder application equipment: On or about December 9, 2004, and at times prior thereto, multiple powder spray booths were operated despite damaged and inoperative flame detection systems. The condition existed on the Epoxy Primer Booth, Black Powder Booth, and Color Powder Booth(s) located on Coating Line One. One feasible means of abatement for this hazard, among others, would be to repair the flame detection systems and maintain their function in accordance with the requirements of the National Fire Protection Association (NFPA) 33, Chapter 9-7.1, 2003 Edition.
