Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm:
On or about December 28, 2004, employees were exposed to the hazard of the
loss of control
of off road seismic survey buggies used in support of a seismic survey.
The operation of
defective buggies by inadequately trained operators coupled with
superficial buggy inspection
can result in the loss of control.  Among other methods, one feasible and
acceptable abatement
method to correct the hazard would be to fully include the buggies in the
employer's current
vehicle operation program including formalizing the training of all
operators, comprehensive
documented buggy inspections with defective buggies removed from service
until repaired.
On December 28, 2004, an employee was driving a buggy from the Lazy S
Ranch, rural Davis,
OK, interior to an adjoining highway, the buggy left the roadway and the
employee
was ejected;
the employee was fatally injured.
