Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: On or about May 13, 2005, at a drilling site north of Coalgate, Oklahoma, Rig #6; while tripping the drill string out of the hole, the weld that connected the hinges that was connected to the derrick failed, causing the derrick/monkey board to fall, striking a floor hand in the head.
