Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: OR IN THE ALTERNATIVE 29 CFR 1910.132(a): Protective seat belt equipment was not maintained in a sanitary and reliable condition: At the jobsite, on or about June 23, 2005; the employer required an employee to operate a 2000 New Holland 6610, serial number 369769M, tractor with roll-over protection system (ROPS) installed with a damaged and unserviceable seat belt. The employee was exposed to the type of hazards that resulted in fatal injuries. Among others, one feasible and acceptable method of abatement would be to replace the belt when it shows signs of fraying, damage or general wear in accordance with the operator's manual for the 2000 New Holland 6610 tractor.
