Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees:
a)In that the employer failed to keep the workplace free from the hazard
of employees
being struck by motor vehicles while working in a temporary traffic
control zone.  On,
or about July 1, 2005, employees were constructing curbs and sidewalks at
various
locations on the eastbound side of US Highway 24 in Independence,
Missouri.  The work
zone was adjacent to the eastbound traffic lane.  Construction included
activities such as,
but not limited to, building forms, pouring concrete from ready-mix
trucks, and forming
poured concrete into curbs and sidewalks.  The temporary traffic control
zone included
channelizer cones instead of barriers to separate traffic from the work
zone.  Employees
were not required to wear high-visibility apparel.  Employees who were in,
and around
the temporary traffic control zone were potentially exposed to injuries
such as, but not
limited to, motor vehicle impact injuries due to not being visible to
passing motorists.
Among other methods, a feasible and acceptable abatement method to correct
this hazard
is to undertake the following steps;
- Ensure employees are provided with, and required to wear high-visibility
apparel in
accordance with the Missouri Department of Transportation 2002 Traffic
Control for
Field Operations Manual.
- Ensure employees are provided with, and required to wear high-visibility
apparel in
accordance with ANSI/ISEA 107-1999, American National Standard for High
Visibility
Safety Apparel.
Abatement certification for this violation is not required.
