Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)On or about December 14, 2005, an employee was exposed to a crushing
hazard
when an unstable Budgit 1 ton hand chain hoist and Manny Maxwell Moore A-
Frame was side loaded while being used to raise the lift arms of a GEHL
Skid
Steer Loader.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE
ABATEMENT METHOD TO CORRECT THIS HAZARD IS:
The employer could follow ASME B30.16.2003 Safety Standard for Cableways,
Cranes, Derricks, Hoists, Hooks, Jacks, and Slings:
(1)Chapter 16-3.1.2(g) Hoists shall not be operated unless the hoist unit
is
centered over the load, except when authorized by a qualified person who
had determined that the components of the hoist and mounting will not be
overstressed.  Should it be necessary to pick a load that is not centered
under the hoist unit, precautions shall be taken to control the swing of
the
load when it is picked clear of its support.
Abatement certification is required for this violation (using the
CERTIFICATION OF
CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating
that abatement is complete must be included with your certification.  This
documentation
may include, but is not limited to, evidence of the purchase or repair of
the equipment,
photographic or video evidence of abatement, or other written records.
