Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of ammonia exposures due to the unsafe design
and operation of
refrigeration systems:
At 3800 E 32nd St, Joplin, MO - the ammonia refrigeration system did not
meet the
applicable requirements for the safe design, construction, installation,
and operation of
refrigeration systems in that:
(a)The refrigerating machinery room door opening into the building did not
open outward and was not self-closing.
(b)The refrigerating machinery room did not contain an operating detector,
located in an area where refrigerant from a leak could concentrate, that
would actuate an alarm and mechanical ventilation.
While ultimate responsibility for correcting the hazards rests with the
employer, given
his/her superior knowledge of the workplace, feasible and acceptable
methods to correct
these hazards, among others, include:
(1)Install the door to the mechanical room so that it opens outwards and is
self- closing as prescribed by Section 8.11.2 of ANSI/ASHRAE 15-2001,
Safety Standard for Refrigeration Systems.
(2)Install an alarm system in the machinery room that complies with Section
8.11.2.1 of the ANSI/ASHRAE 15-2001, Safety Standard for
Refrigeration Systems.
Abatement Note: Abatement certification is required for this item - use the
CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.T
