Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a).Worksite located at 632 Old Mill Road, Hollister, Missouri- On or
about January
21, 2006, an employee who was working on an a.m. radio tower was killed as
a result of a fall when a bulldozer, operating near one of the anchors for
the
tower, became entangled with the tail of the guy wire, thus, causing the
grip of
the guy wire to pull out and the tower to fall.
Among other methods, one feasible and acceptable method to correct this
hazard is to establish
and enforce a written work rule or policy that no equipment or employees,
other than those
performing the tower erection, be allowed to work in the vicinity of the
tower that is being
erected. This would include work being performed around guy wires and
anchorages.
Note-Abatement certification is required for this violation (using the
CERTIFICATION OF
CORRECTIVE ACTION WORKSHEET), and in addition, documentation
demonstrating that
abatement is complete must be included with your certification.  The
documentation may
include, but is not limited to, evidence of the purchase or repair of the
equipment, photographic
or video evidence of abatement, or other written records.
