North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to:
a)warehouse, employees did not utilize a fall protection system or
restraint device
when utilizing the B/T Prime Mover Electric Counterbalanced Order Selector,
Model OE35, Serial No. OE350244687, which was equipped with a job made
product basket attachment.
Note:  American Society of Mechanical Engineers (ASME) B56.1-2000 states in
paragraph 4.17.2(c):  "be certain that required restraining means such as
railings, chains,
cable, body belt(s) with lanyard(s) or deceleration devices, etc., are in
place and properly
used".
Note:  BT Operators Manual states on page 13 "Always wear tether line and
safety belt".
