employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or physical harm to employees in that
employees were exposed to:

empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que puedan causar
muerte o dano fisico a los empleados, por cuanto empleados estaban
expuestos a:
At Sealy Mattress Co. of Puerto Rico located at Urb. Industrial El
Comandante Ave. San Marcos
#1 Carolina, it was learned that the employer failed to follow spring
units crate warning having
an employee working on a broken Bale opener, manufactured and sold by
SpGhlAnderson, BK6
model, 6137 serial number, using two 2 ton chain hoists to hold the die
down in order to hold a
15 compressed spring units while the employee cut the wires that held it
compressed.
The
employee stood on top of the die and the compressed spring units while
cutting the wires.  While
the employee cut the wires the chain hoist, manufactured by Wisdom,
16-CH2W-1 model no.,
next to the Bale opener controls, failed. The spring mattress units
decompressed at once and
catapulted the press die and employee.
Therefore, the employer had employees working:
With and on a defective press;
a press modified substituting the mechanism that kept compressed the
spring units
and decompressed them, with two chain hoist;
failing to follow the compressed spring units crate warning which stated
failure to
use equipment capable of sustaining at least 18,000 pounds of force may
result in
serious injury by substituting the mechanism that kept compressed the
spring units
and decompressed them, with two chain hoists having a load capacity of 2
Ton
each; and
having an employee cutting the wires that kept the crate spring units
compressed,
while standing on top of the crate.
Among other methods, one feasible and acceptable abatement method to
correct this hazard was:
Replace the Bale opener press.
Render out of operation the Bale opener until fixed.

En Sealy Mattress Co. de Puerto Rico localizado en la Urb. Industrial El
Comandante Ave. San
Marcos #1 Carolina, se llego al conocimiento de que el patrono fallo al no
seguir la advertencia
del embalaje de unidades de resortes al tener empleados trabajando en un
Bale Opener
manufacturado y vendido por SpGhlAnderson, modelo BK6, numero de serie
6137, usando dos
gruas de cadena para mantener el dado abajo, para mantener las quince
unidades
de resortes
compresas, mientras el empleado cortaba los cables que las mantenian
compresas.  El empleadose paraba encima del dado y de las unidades de
resortes compresas mientras cortaba los cables.
Mientras el empleado cortaba los cables, la grua de cadena, manufacturada
por Wisdom, numero
de model 16-CH2W-1, que se encontraba cerca de los controles del  Bale
opener fallo.  Las
unidades de resortes se descomprimieron subitamente, lanzando al dado de
la prensa y al
empleado.
Resumiendo, el patrono tenia empleados trabajando:
Con y encima de una prensa defectuosa;
una prensa que habia sido modificada substituyendo el mecanismo que
mantenia las
unidades de resorte compresas y que las descomprimian, usando dos gruas de
cadena.
fallando en seguir la advertencia de peligro del embalaje de unidades de
resorte que
decia:  fallar en utilizar equipo capaz de resistir por lo menos 18,000
libras de
fuerza puede resultar en dano fisico serio, sustituyendo el mecaniasmo que
mantenia compresas las unidades de resorte y que las descomprimia, con dos
gruas
de cadena que tenian una capacidad cada una de 2 toneladas; y
mantener empleados cortando los cables que mantenian compresas las
unidades de
resortes, mientras se paraban encima del embalaje.
Entre otros metodos, algunos accesibles y aceptables eran:
Reemplazar la prensa  Bale opener.
Declarar fuera de operacion la unidad  Bale opener hasta que fuese
reparada.
