Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: Employees were exposed to vomits, headache, itching nose and eyes, throat irritation, constant coughing and asphyxia due to the objectionable odors leakage inside school. At the Departamento de Educacion, at Escuela Nuestra Senora de Covadonga, where the employees were doing learning duties, it was documented the following: 1) The fat trap was operating as a solid precipitation pit allowing the escape of solids thru the dragging line up to pump station that was flowing to the terrain. 2) It was observed that the school sewage water pump station was out of service. A smoke test was conducted on march 15, 2006 by Junta de Calidad Ambiental Staff to identified the sites by where the objectionable odors were leaking and enter to the place of employment where the employees were working. The results of these test were the following: Smoke test #1: Smoke was injected from cleaning register located at the back of the bathrooms of first level and it were found and documented the following: 1) Smoke leakage: at the first level of the school, by discharge pipes where in the past exist a drinking fountain. 2) Smoke leakage: at the boy's bathroom in the first level of the school, by discharge pipes of a lavatory. 3) The first level ventilators emissions shift inside the school. Smoke test #2: Smoke was injected from exposed discharge pipes at the schoolar lunchroom and it was observed the following: 1) At the schoolar lunchroom: smoke leakage by exposed pipe under washbowl annexed at the food service zone. 2) At the schoolar lunchroom: smoke leakage by exposed pipe at the wall that accesss to exit schoolar lunchroom supervisor office. 3) At the schoolar lunchroom: smoke leakage at the discharge link-up of a multiple kitchen sink in use. 4) Smoke leakage by a cleaning register next to the fat trap. 5) Smoke leakage by fat trap discharge link-up. Among another methods, feasible and acceptable methods are the following: 1) Improve the fat trap discharge link-up. 2) Correct the defects on the discharge pipes found by smoke test. 3) Fix the schoolar sewage water pump station. Empleados estuvieron expuestos a vomitos, dolor de cabeza, picor en los ojos y nariz, irritacion de garganta, tos constante y asfixia debido a los escapes de olores objetables dentro del plantel escolar. En el Departamento de Educacion, en la Escuela Nuestra Senora de Covadonga, donde los empleados estaban dando clases, se documento lo siguiente: 1) Trampa de grasa estaba operando como un poceto de precipitacion de solidos permitiendo la fuga de las mismas por la linea de arrastre hasta la estacion de bombas que esta descargando al terreno. 2) Se observo que la estacion de bombas de aguas usadas del plantel estaba fuera de servicio. Personal de la Junta de Calidad Ambiental realizo una prueba de humo el dia 15 de marzo de 2006 con el proposito de identificar los lugares por donde se escapaban los olores objetables e invadian los lugares donde laboraban los empleados de la escuela. Los resultados de las pruebas fueron los siguientes: Prueba de Humo #1: Se inyecto el humo desde el registro de limpieza de la parte posterior de los banos del primer nivel y se encontro y documento lo siguiente: 1) Escape de humo por la tuberia de descarga donde en el pasado habia una fuente de agua en el primer nivel. 2) Escape de humo por tubo de descarga de un lavamanos en el bano de ninos del primer nivel. 3) La emision de los ventiladores del primer nivel se desplaza hacia el interior de la escuela. Prueba de Humo #2: Se inyecto humo por una tuberia de descarga expuesta en el comedor escolar y se observo lo siguiente: 1) Escape de humo por tubo expuesto bajo contenedor de enjuague anejo a la zona de servicio de comidas. 2) Escape de humo por tubo expuesto localizado en la pared que da acceso a la salida de la oficina del supervisor de comedores. 3) Escape de humo en la acometida de descarga de los fregaderos multiples en uso. El humo gana acceso hasta la linea de un receptaculo eletrico inmediato al contenedor del lavado. 4) Escape de humo por un registro de limpieza inmediato a la trampa de grasa. 5) Escape de humo por las acometidas de descarga de la trampa de grasa.
