Section 5(a)(1) of the Occupational Safety & Health Act of 1970:  The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees, in
that, an employee was
exposed to the hazards of being struck by unsecured eight (8) inch by
twenty (20) foot ductile
water pipes being unloaded from the semi trailer.
Location:  Roberson Street, Fall River.
An employee standing on the top tier of the eight (8) inch by twenty (20)
foot
ductile water pipes was seriously injured when the water pipes shifted
while being
unloaded, causing the pipes with the employee on top to roll off the
trailer and
fall to the ground, striking the employee.
Among other methods one acceptable method would be to establish safe
procedures for unloading pipe, to include but not limited to, leaving the
siderails
up on the opposite side of the truck during unloading, strapping down the
lower
tiers of pipe until ready to unload, and not allowing the employee  to
stand on the
pipe being unloaded, and then to train the employees in these safe
procedures.
