Section 5(a)(1) of the Occupational Safety & Health Act of 1970:  The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees, in
that, employees were
exposed to the hazards of being struck by falling dumpsters being hoisted
by using hoisting
equipment that was damaged.
Location:  Electric hoist dumpster raising and lowering area.
a).  One of the down leg supports for the trolley system was severely bent
and
the hoist had not been removed from service until repaired.
b).  The hook had not been tested by a suitable crack testing proceedure
at least
once a year.
c).  A latch type hook with a latch was not used.
d).  The support system for the trolley was not marked as to the load
rating.
e).  Appropriate warning labels were not attached to the hoist.
Among other methods, one feasible and acceptable method to correct these
hazards is to
label, inspect, repair, and keep written records of the hoist as outlined
in the ANSI
B30.16.1973, Including but not limited to, repairing the down leg support
system, having
the safety latch on the hook repaired, perform the appropriate annual
testing of the hook,
mark the support system as to its rated load capacity, install the
appropriate warning
labels, inspection records of the hoist and hook should be readily
available.
