Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from a stock picker while not wearing fall protection. Among other methods, feasible means of abatement would be to follow the manufacturer's fall protection recommendations set forth in the operator's manual. (a) Location - Rack #2, Bay #7: On or about 09/28/2004, the employee was exposed to the hazard of falling while working from a Crown order picker powered industrial truck.
