Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being hit by the compression ram on the strapping machine: (a) Location - Strapping Area: On or about 7/22/04, employees were exposed to being struck by the compression ram on the strapping machine while entering under the machine to hand push large pallets into place. Among other means, one feasible means of abatement would be to: Fix the automatic feed conveyor on the machine to prevent the necessity of employees pushing the pallets into place.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being hit by the die-cut stacker: (a) Location - Die Cut Area: On or about 9/24/04, employees were accessing the area under the Bay Machinery Company Rotary Die-Cut Stacker, Serial #1053. Among other means, one feasible means of abatement would be to: 1. Provide a pole to hold the first few sheets of a pallet so that the employee does not have to go under the machine. 2. Teach employees to slide the cardboard bottom sheets onto the rollers without going under the stacker. 3. Only allow an employee under the stacker under a lockout/tagout procedure whereby a block is placed between the stacker and the floor to prevent movement. The Massachusetts Container Corporation was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 5(a)(1) which was contained in OSHA Inspection Number 306099540, Citation Number 1, Item Number 1, issued on 01/21/2004 with respect to a workplace located at 300 Cedar Hill Street, Marlborough, MA.
