Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:

El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
Ref. 10 OSH 1926.16(a) ... In no case shall the prime contractor be
relieved of overall
responsibility for the compliance with the requirements of this part for
all work to be performed
under the contract.
Aziz & Son's Inc. was the prime contractor in this construction having
Wekando
Construction
Inc. working at the site under a contract.

general de la
responsabilidad general de cumplir con los requisitos de esta Parte para
todos los trabajos que
se realizaran bajo el contrato.
Aziz & Son's Inc. era el contratista general en esta construccion y
Wekando Construction Inc.,
trabajaba para ellos en este establecimiento bajo un contrato.
At the Storage Room inside the Ball Room Expansion Project, located in the
El
Conquistador Hotel of Fajardo PR, employees were observed walking in the
area where
yellow cartridge powder bullets without being fire laid on the floor. The
employees
performing theirs tasks using powder-actuated tool DX460 trademark Hilti
with which
using yellow cartridge powders bullets to fastening materials on walls and
roofs.
Among other correction methods to correct this hazard is gather all yellow
cartridge
powders bullets without being fire or fire immediately and create a method
to arrange the
same.
Hazard: The employees were exposed to explosion in the eventuality that
any tool or
equipment fell over the yellow cartridge powders bullets without shooting.
En el Storage Room dentro del Proyecto Ball Room Expansion, localizado en
el Hotel
El Conquistador de Fajardo PR, empelados fueron observados caminar por el
rea donde
cartuchos amarillos de balas de polvoras sin disparar estaban puestos en
el suelo. Los
empleados realizaban sus tareas usando un Martillo de Disparo DX460 marca
Hilti con
el cual utilizaban cartuchos con balas de polvora (amarillos) para la
fijacion de materiales
en paredes y techos.
Entre otros metodos para corregir este riesgo es recoger todos los
cartuchos con balas
disparadas o sin disparar inmediatamente y crear un metodo de disposicion
de los
mismos.
Riesgo: Los empleados estaban expuestos a explosion en la eventualidad que
alguna
herramienta u equipo cayera sobre los cartuchos de balas sin disparar.
