Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a module haul truck having an obstructed view to the rear : On or about October 21, 2004 and at times prior thereto, at the establishment located at 10415 Stuckey Lane, in Trumann, Arkansas, employees were exposed to the hazard of being struck by a cotton module haul truck having an obstructed view to the rear where adequate measures were not taken to warn personnel on the ground that the equipment was backing up or to ensure that equipment could be backed up safely. Some feasible and acceptable means of abatement, among others, are: (1) install and properly maintain a functioning reverse signal alarm (2) install and properly maintain a functioning reverse signal flashing light (3) install a large convex mirror at the cotton module feeder table area enabling the truck driver to see the complete area behind the truck (4) install a signal light that indicates to the truck driver that the area in front of the feeder table is not clear or safe to back into and/or (5) use a observer/signal person to signal to the driver when it is safe to back up.k
