Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
Ref. 10 OSH 1926.16(a) ... In no case shall the prime contractor be
relieved of overall
responsibility for the compliance with the requirements of this part for
all work to be performed
under the contract.
Carlos R. De Jesus Cintron DBA CR Pipe Plumbing & Sanitary Service was the
prime
contractor in this construction having Josi L. Vazquez Ocasio DBA JL
Vazquez Services
working at the site under a contract.
ALTERNATIVE: Due to the equivalence of the Occupational Safety and Health
Standard
(Puerto Rico Occupational Safety and Health Act, section 6 A to other
Standards, Carlos
R. De Jesus Cintron DBA CR Pipe Plumbing & Sanitary Service is cite in the
alternative
for the following Occupational Safety and Health Standards: 1926.451 (g)
(1); therefore
instead of penalizing for the violation of each Standard, only one fine is
assessed for the
violations cited in the alternative.
Employees of Jose L. Vazquez Ocasio DBA JL Vazquez Services were exposed to
fractures and death due to a fall hazard. The employees were being
standing over a pallet
attached to forks of a Rough Terrain Telescopic Boom Material Handler
(Trade mark
Grandall, model#534c-6, serial#0388899), while worked in welding task at a
height
of
10 feet from the ground at the new gasoline station (Texaco) construction
project, located
in road #3 Quebrada Huertas sector in Fajardo PR.
Among other methods, one feasible and acceptable method to correct this
hazard is
provide fall protection for employees working at elevated levels such as a
fall protection
system and or scaffolds to perform theirs task.

general de la
responsabilidad general de cumplir con los requisitos de esta Parte para
todos los trabajos que
se realizaran bajo el contrato.
Carlos R. De Jesus Cintron DBA CR Pipe Plumbing & Sanitary Service era el
contratista
general en esta construccion y Jose L. Vazquez Ocasio DBA JL Vazquez
Services, trabajaban
para ellos en este establecimiento bajo un contrato.
ALTERNATIVA: Debido a la equivalencia entre la Norma de Seguridad y Salud
Ocupacional Ley de Seguridad y Salud en el Trabajo, seccion 6 A y otras
Normas, secita a la Carlos R. De Jesus Cintron DBA CR Pipe Plumbing &
Sanitary Service en la
alternativa por las normas de Seguridad y Salud Ocupacional: 1926.451 (g)
(1); por lo
que en lugar de multar por separado cada una de estas Normas, se multa una
sola vez
por las violaciones citadas en la alternativa.
Empleados de Jose L. Vazquez Ocasio DBA JL Vazquez Services fueron
expuestos a
fracturas y muerte debido a riesgo de caidas. Los empleados estaban
parados sobre una
paleta unida a las horquillas de un montacargas telescopico para terreno
escabroso
(modelo 534c-6, serie #0388899), mientras trabajaban en tareas de
soldaduras a una
altura de 10 pies del suelo en el proyecto de construccion de nueva
gasolinera (Texaco),
localizado en la carretera #3 sector Quebrada Huertas en Fajardo PR.
Entre otros metodos, un metodo apropiado y aceptable para corregir este
riesgo
es
proporcionar proteccion de caida para los empleados que trabajan en
niveles elevados
tales como un sistema de proteccion contra caida y/o andamios para
realizar sus tareas.
