Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and caught in hazards while working beside a GOMACO C-450 Cylinder Finisher: a) On or about 11/10/04, at the Route 62 in South Dayton, New York, an employee was struck-by and caught in between the wheels and guide rail of a GOMACO C-450 Cylinder Finisher, serial number MC-16860-08, when it unexpectedly moved. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS CONDITION IS: 1) Be certain that the area around the machine is clear before moving. 2) Keep hands and feet free of moving parts. 3) Utilize available features, such as front and rear rail wipers, to guard nip points. ABATEMENT CERTIFICATION REQUIREDATION
