Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: Employees of Girard Manufacturing, Inc., at the warehouse, were exposed to serious head injuries such as and not limited to cuts and cranium fractures due to the height of the mezzanine who was 5 feet 5 inches from the ground. The employees need to lean for store materials under the mezzanine. The employer do not provided helmets to protect the employees, or post a warning sign about the height of the mezzanine or risks under the same. Among other methods, one feasible and acceptable method to correct this hazard is providing helmets to protect the employees or to increase the mezzanine height. Los empleados de Girard Manufacturing, Inc., en el almacen, estaban expuestos a lesiones serias a la cabeza tales como y no limitadas a cortaduras y fracturas de craneo debido a que la altura del entrepiso (mezanine) estaba a 5 pies 5 pulgadas del suelo. Los empleados necesitaban inclinarse para almacenar materiales bajo el entrepiso (mezanine). El patrono no proveyo capacetes para la proteccion de los empleados, ni coloco un letrero de advertencia sobre la altura del mezanine o los riesgos bajo el mismo. Entre otros metodos, un metodo apropiado y aceptable para corregir este riesgo es proporcionar capacetes para proteger a los empleados o aumentar la altura del entrepiso (mezanine).
