Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that an employee was exposed to potential crushing injuries or death: On or about August, 2004, an employee received on the job training in the operation of a Sterling "5th wheeler" semi tractor truck used to spot and move trailers at the employer's loading dock. The truck cab was not equipped with a passenger seat and seatbelt. The trainee sat on an unsecured metal four-legged chair and did not wear a seatbelt. ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM One feasible means of abatement, among others, would be to install a passenger seat and seatbelt in the truck cab in accordance with the vehicle manufacturer's specifications (Sterling).
