Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that:
On December 22, 2004 an employee performing a maintenance task on a dock
door was
standing on a wooden pallet set on the forks of a Toyota forklift, model
42-6FGCU15,
raised approximately 10-12 feet above floor level.  The employee was
exposed to fall
hazards in that there was no fall protection available or in use, and the
pallet was not an
approved work platform.
Among other methods, one feasible and acceptable abatement method would be
to utilize only
platforms designed for use in elevating personnel with forklifts, as set
forth in ANSI-ASME
B56.1-2000.  Additionally, employees should be trained on the proper
methods to reach
elevations in which to work, use of approved safety platforms, and
appropriate fall
arrest/restraint systems.
ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIRED.
