Public Law 91-596 Section 5(a)(1) Each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees in that employees were exposed to struck by hazards while releasing lift pins with inoperable or missing cutting levers to uncouple railcars. Inside a captive rail yard, employees frequently positioned themselves between railcars during the releasing of lift pins to couple or uncouple railcars while at the same time operate the locomotive with a remote control device. Instance A: Railcar C5, the cutting lever for the lift pin was missing from both ends of the car. Instance B: Railcar C9, the cutting lever for the lift pin was missing from both ends of the car. Instance C: Railcar C11, the cutting lever for the lift pin was missing from one end of the car. Instance D: Railcar C16, the cutting lever for the lift pin was missing from one end of the car. Instance E: Railcar C21, the cutting lever for the lift pin was missing from one end of the car. Instance F: Railcar C22, the cutting lever for the lift pin was missing from one end of the car. Instance G: Railcar C24, the cutting lever for the lift pin was missing from one end of the car. Instance H: Railcar C29, the cutting lever for the lift pin was missing from one end of the car. Instance I: Railcar C31, the cutting lever for the lift pin was missing from one end of the car. Instance J: Railcar C50, the cutting lever for the lift pin was missing from one end of the car. Instance K: Railcar C58 the cutting lever for the lift pin was missing from one end of the car. Among others, one feasible and acceptable method to correct this hazard is to comply with the requirements of Azcon Corporation, Sterling Scrap Processing Yard, Safe Railroading Work Practices. Use cutting levers only to couple or uncouple railcars and locomotives. Ensure that reported inoperable or missing cutting levers on railcars and locomotives are repaired prior to placing the railcar into service. Certification of abatement is required by 29 CFR 1903 and is to be submitted within ten (10) calendar days after the abatement date.
