Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that an employee was exposed to fall hazards when working from an elevated scissor lift platform with a defective guardrail system. Lube Center. An employee was exposed to a fall of approximately 15 feet while working from the platform of an elevated JLG Commander scissor lift (Model #1732, SN# CO38820) to turn off an air hose mounted near the ceiling. a.The midrail chain could not be secured due to a broken clasp, and was not used by the employee. b.There was a bolt missing where the sides of the guardrail system were joined together. c.The employer's pre-operational inspection and checklist did not include inspection of the guardrail system. d.The lift was not taken out of service until repaired. One feasible means of abatement, among others, would be to comply with the American National Standards Institute ANSI/SIA A92.6-1999 standard for "Self-Propelled Elevating Work Platforms" as follows: A)Ensure that a visual inspection and functional test of the scissor lift is performed before use each day or at the beginning of each shift which includes, but is not limited to, the following areas: 1) Operating and emergency controls 2) Safety devices 3) Personal protective devices 4) Air, hydraulic and fuel system leaks 5) Cables and wiring harness 6) Loose or missing parts 7) Tires and wheels 8) Placards, warnings, control markings and operating manual(s) 9) Outriggers, stabilizers and other structures 10) Guardrail system 11) Items specified by the manufacturer (See Section 7, Responsibilities of Users 7.3.3 and Section 8, Responsibilities of Operators 8.3.) B)Establish procedures to ensure that the lift is taken out of service when damaged or in need of repair, until repairs are accomplished. (See Section 6, Responsibilities of Owners, 6.4.3.) C)Monitor operator training and work practices to ensure that prior to each elevation of the platform, the operator ensures that guardrails and access gates or openings are closed. (See Section 7, Responsibilities of Users, 7.10(4) and Section 8, Responsibilities of Operators, 8.8 and 8.10.) There is no abatement certification or documentation required for this item.
