Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were not protected from automatic restart of metal-cutting saws: The Jet horizontal band saw did not have magnetic restart provisions. ANSI B11.10-2003, Section 6.11 states that in the event of control voltage or power-system failure, a separate starting operation shall be performed to restart the motor when power conditions are restored to normal. A feasible means of abatement would be to provide a magnetic restarter or similar device as required by ANSI B11.10-2003. Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).
