5(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushing and amputation hazards caused by the unintentional operation of an unguarded foot pedal on the Di-Acro Press Brake, No. 172. An unguarded foot pedal on a press brake could be activated by falling objects or accidental operator contact. One feasible and acceptable abatement method to correct this hazard is to guard the foot pedal as referenced in ANSI B11.3-2002, Safety Requirements for Construction, Care, and Use of Power Press Brakes, Section 6.10.3.
