Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: a)Stroke and/or crush do to failure by the roll-over protective structure of an earth moving equipment: At the Agricultural Mechanization Program of San Sebastian city - employees were operating a John Dear 750B bulldozer with the roll-over protective structure (ROPS) modified by welding a tubular structure to the front uprights of the ROPS. The equipment was involved in an overturn accident on October 10, 2005. The front upwrights of the ROPS failed at the two points where the tubular structure was welded. The operator was injuried by the ROPS. The ROPS had a label indicating not to be modify without the approval of the manufacturer. The operators manual had an indication that ROPS protection will be impaired is in any way altered by welding. The tubular struture was installed to protect the exhaust pipe and to protect employees from been struck by tree branches. Among other methods one available and feasible method to correct this hazard is to buy the equipment with the optional devices installed by the manufacturer. a)A ser golpeados y/o aplastado por fallo por la estructura de proteccion para vuelcos. Programa de Mecanizacion Agricola del pueblo de San Sebastian - empleados estaban operando un bulldozer John Dear 750B con la estructura de proteccion para vuelcos modificada soldando una estructura tubular a los soportes del frente. El equipo estuvo envuelto en un accidente de vuelco el 10 de octubre de 2005. Los soportes frontales de la estructura de proteccion para vuelcos fallo en los dos puntos donde la estructura tubular fue soldada. El operador fue herido por la estructura de proteccion para vuelcos. La estructura de proteccion tenia un rotulo indicando que no debia ser modificada sin la aprobacion del manufacturero. El manual del operador tenia una indicacion que la proteccion de la estructura estaria afectada si de alguna forma es alterada por soldadura. La estructura tubular fue instalada para proteger el tubo de escape y para proteger los empleados de ser golpeados por las ramas de los arboles. Entre otros metodos un metodo disponible y apropiado para corregir este riesgo es comprar el equipo con los dispositivos opcionales instalados por el manufacturero."
