Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: a)Stroke and/or crush by a fence in danger of collapse by its own weight and wind force. The fence was constructed of 10 feet long by 3 feet corrugated galvanized zinc sheets vertically positioned. The sheets were nailed to 1 inch x 4 inch wood batten boards. The 60 feet long fence was kept in an upright position by timbers cut from tree branches. The fence was shored every 15 feet by these timbers. The fence waved with little pressure and with the force of the wind. Among other methods one available and feasible method to correct this hazard is to use wood components with a minimum of 1500 lb-ft/in2 fiber (stress grade) construction grade lumber; the posts shall be at least 2-inch by 4-inch lumber spaced not more than 8 feet apart on centers with shorings of the same grade and dimensions. These are the performance standard minimum requirements for wood railings contained in item 1 of Appendix B, Subpart M of 10 OSH 1926. a)A ser golpeados y/o aplastado por una verja en peligro de colapsar por su propio peso y la fuerza del viento. La verja estaba construida de planchas de zinc galvanizado corrugado de 10 pies de largo por 3 pies de ancho colocadas en forma vertical. Las planchas estaban clavadas a alfagias de 1 pulgada x 4 pulgadas. La verja de unos 60 pies se mantenia en forma vertical por palos cortados de ramas de arboles. La verja estaba apuntalada por estos palos cada 15 pies. La verja se balanceaba con una presion minima y con la fuerza del viento. Entre otros metodos un metodo disponible y apropiado para corregir este riesgo es utilizar componentes de madera de grado de construccion con una grado de tension de la fibra de 1500 lb-pies/pulg2; los postes deben ser de al menos de palos de 2 pulgadas x 4 pulgadas espaciados no mas de 8 pies de centro a centro apuntalados con piezas de madera del mismo grado y las mismas dimensiones. Estos son los requisitos minimos de rendimiento para barandas de madera contenidos en el renglon 1 del Apendice B del 10 OSH 1910 1926."ce
