Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) Production Plant: On or about December 9, 2004 the employer failed to
specify an
embedded lift anchor of adequate capacity for installation into the "pipe
organ" element
to support the imposed load during the tilt up procedure.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to conduct an evaluation of the product application, determine the
appropriate safe working loads
and control all field conditions to prevent application of loads in excess
of the safe working load.
Manufacture's product information is one source available to the employer
to conduct this
evaluation and selection of the appropriate capacity anchor.  To prevent a
deviation
from the
installation specifications, the information must be conveyed to
supervisory, setup and quality
control personnel.
Abatement certification and documentation required within 10 days after
abatement date.  The
certification shall include a statement that abatement is complete, the
date and method of
abatement, and state that employees and their representatives were
informed of this abatement.
Abatement documentation shall include documents demonstrating that
abatement is complete,
such as evidence of the purchase or repair of equipment, photographic or
video evidence of
abatement or other written records.

procedure.

and control all field conditions to prevent application of loads in excess
of the safe working load.
