Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the unintended operation of a machine: a) Foundry Room: The employer does not furnish employment and a place of employment that is free from recognized hazards that are causing or likely to cause death or serious physical harm to employees. This is evident by the fact that on or about 09/16/2006, employees operated an S Q Common Brass Cutter, and the pedal mechanism used to operate the machine was not equipped with a cover, and not equipped with a non-slip pad firmly attached. The provision of this equipment would protect the employee from the unintended operation of the brass cutter. To abate this violation, the employer must ensure the pedal mechanism used to operate the machine is equipped with a cover, and equipped with a non-slip pad firmly attached. Pursuant to 29 CFR 1903.19(c) and (d), the employer must provide documentation that this specific violation above has been abated within 10 calendar days of the abatement date. Abatement Note: Among other methods, one feasible and acceptable abatement method is to provide a cover for the pedal mechanism, and a non-slip pad firmly attached, in accordance with ANSI B11.4-2003, consensus Safety Requirements for Shears.
